New anti-dumping case on urea ammonium nitrate solutions from Belarus, lithuania, ukraine and the Russian federation





  An anti-dumping (AD) petition on Urea Ammonium Nitrate Solutions from Belarus, Lithuania, Ukraine and the Russian Federation has been filed at the US Department of Commerce (DOC) and the US International Trade Commission (ITC) on behalf of US producers by the Nitrogen Solutions Fair Trade Committee (NSFTC). Members of the NSFTC include, Terra Industries, Inc., CF Industries, Inc., and the Mississippi Chemical Corporation. The petition alleges that surging imports of urea ammonium nitrate (UAN) from the named countries into the United States are materially injuring the US industry. In an unusual request, the petitioners have asked the DOC for an expedited preliminary determination, which could force US importers to post cash or bond deposits for preliminary dumping margins as early as 45 days – rather than the usual 140 days – following the DOC initiation of the investigation. Petitioners are alleging the following dumping margins based on imports over the October 2001 to January 2002 period: Russia 327%; Belarus 76%; Lithuania 104%; and Ukraine 144%. UAN is a liquid nitrogen fertilizer that is commonly used to fertilize pre-emergent crops, including row crops, such as corn, tobacco, sugar cane, cotton, wheat, peanuts, and pasture. In addition, because it is a liquid that is surface-applied, UAN is used extensively for side-dress applications and also for no-till or minimum till farming. AD cases are commenced by the simultaneous filing of a petition with the DOC and the ITC, which then conduct an investigation and, if there is an affirmative finding by both agencies, the DOC issues an AD order. US importers of merchandise from countries covered by an order must post estimated AD duties at the time of entry equal to the value by which the goods have been found to be undersold in the United States. These rates may be reviewed in the future upon the request of any of the involved parties. The mere filing of a petition can be disruptive, often leading to either an increase in the price of the product or the supplier being forced out of the US market. Many importers and their customers, however, encourage their overseas producers/exporters to promptly seek the advice of trade counsel to ensure that their vital suppliers remain active players in the US market.
